What is a Sworn Declaration
A Sworn Declaration is a formal statement, signed under oath, submitted by a taxpayer to a withholding agent (payor) claiming exemption on certain income payments. It is an important part of regulatory compliance that helps us determine whether we need to withhold 1% on one-half of the gross remittances for transactions that goes through the platform.

How to get a Sworn Declaration
Fill out the Sworn Declaration. Prepare minimum 4 copies.
Have the Sworn Declaration notarized by a Notary Public. (1 copy will be retained by the Notary Public)
Submit the Notarized Sworn Declaration to your BIR RDO for Doc Stamping. (1 copy will be retained by the BIR RDO)
*Note: In rare cases where the BIR does not receive the document, simply submit to us and let us know. We will still include these in our submission to the BIR.

Steps to submit Sworn Declaration to SeriousMD:
Step 1: Navigate to "My Profile" > "BIR Form 2303"
Step 2: Tick "Are you exempt from Withholding Tax?"
Step 3: Upload your Sworn Declaration by clicking the "Upload Sworn Declaration" button along with your BIR Form 2303.
This digital copy allows us to verify if the sworn declaration is the correct one that is needed.
Step 4: Please send a physical copy of Sworn Declaration to SeriousMD

Frequently Asked Questions
1. Do I just submit the Sworn Declaration one time?
You will have to submit a new Sworn Declaration by January 31st of each new year.
2. What happens after I have submitted a Sworn Declaration and I have already exceeded 500k in gross annual earnings in SeriousMD?
We will have to keep track and automatically withhold prospectively from the date when such remittance exceeds Php500k. Alternatively, you may notify us that you have breached the threshold, so that we can withhold prospectively from then on.
3. My payouts have already been withheld tax and I submitted a sworn declaration. Will I get the amount that was withheld to me before?
Exemption from withholding tax is applied for current unpaid and future payouts upon validation of a valid Sworn Declaration. No retroactive adjustments are possible once withholding tax has been applied.
4. What happens if I do not submit either BIR Form 2303 nor a Sworn Declaration?
For users that have not responded to the Regulatory Compliance portion and indicated whether they are exempt or not-exempt from the new Withholding Tax regulation, we will be holding the payout until we receive a response.
For users that choose not to provide even the BIR 2303 form, a fee of 25% will be deducted from their payout to cover the additional VAT and taxes that we will be incurring.
5. I already have a Sworn Declaration from before is this the same?
No. Majority of professionals have a Sworn Declaration regarding their income not exceeding Php3M. This Sworn Declaration cannot be used for exemption in this new regulation. Kindly download the Sworn Declaration here
